Terms of Use

Last updated: October 2026

1. Provider and scope

KeepUp (web app at app.keepupsquad.com) is run by Moritz Gärtner (address in the Imprint), "we" or "us" below. These Terms apply to your use of KeepUp. By creating an account, you agree to them.

2. What KeepUp is

With KeepUp you check in at the gym with a photo, set a weekly goal with friends in squads and see a ranking. KeepUp is currently free. There is no entitlement to any particular availability or feature. We may change or limit features or shut the service down; we will announce a shutdown in the app at least two weeks in advance so you can save your content. If paid features are added in the future, separate terms will apply that you have to accept separately.

3. Your account

4. Rules for photos, comments and GIFs

You are responsible for everything you post. In particular, the following is not allowed:

Many gyms restrict photography. Follow your gym's house rules.

If you break these rules and a third party makes a claim against us as a result, you will indemnify us against that claim, including reasonable legal costs, to the extent you are at fault.

5. Rights to your content

Your photos and comments remain yours. You only grant us the non-exclusive, free right to store them, process them technically (e.g. resize them) and show them to the members of your squads, as far as this is necessary to run KeepUp. We do not use your content for advertising and do not pass it on to third parties, except to the technical service providers listed in the Privacy Policy. This right ends when you delete the content or your account.

6. Reporting, review and suspension

7. Health

KeepUp is a motivation app, not training, nutrition or medical advice. You train at your own risk. Goals, streaks and rankings are no reason to train while injured, ill or beyond your limits. If you have health concerns, talk to a doctor first.

8. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, under mandatory product liability law and where we have given a guarantee. As KeepUp is free, we are otherwise not liable for slight negligence. We recommend keeping important photos on your device as well.

9. Ending the use

You can stop using KeepUp at any time by deleting your account. We can end your use with two weeks' notice, or immediately for good cause (in particular serious or repeated violations of section 4).

10. Changes to these Terms

We may change these Terms for a valid reason (e.g. new features or new laws). We will tell you about changes in the app in advance. Changes that materially affect your rights or obligations only apply if you agree to them.

11. Final provisions

Dutch law applies. If you are a consumer, the mandatory consumer protection rules of the country where you live remain unaffected. If any provision is invalid, the rest remain valid.
